Distance contract

This contract is concluded between the owner of the shopping website www.hercs.lv – SIA HERCS FLORA, unified registration number 40003584112, registered office: Vecpilsetas iela 8A-7, Riga, LV-1050, hereinafter referred to as the Seller, and the Buyer who places an order and makes a purchase on the shopping website www.hercs.lv. The distance contract applies to all orders and purchases made on the shopping website www.hercs.lv. This Distance Contract does not apply to purchases made by the Buyer through the Seller’s other communication channels.

  1. The Buyer orders, purchases and pays for, and the Seller delivers and sells house and ornamental plants and flower pots, hereinafter referred to as the Products, in accordance with the provisions of this contract, hereinafter referred to as the Contract.
  2. The Buyer orders the Products by filling out the respective order form on the Seller’s website www.hercs.lv. When placing an order, the Buyer undertakes to specify accurate information, i. e, name, surname, delivery address and the Buyer’s contact information, and click on the Order field. The Buyer undertakes to inform the Seller of any changes within 24 hours after receiving the order confirmation by e-mailing to anna@hercs.lv. The Buyer is responsible for the correct provision of information, otherwise the delivery of the Products is not guaranteed. The order of the Products is deemed the Buyer’s proposal to the Seller to conclude this Distance Contract on the delivery of the ordered Products and the Buyer’s consent to purchase the ordered Products for the specified price. The personal data related to the delivery of the Products is not transferred to any third parties.
  3. The Seller delivers the Products to the address specified by the Buyer according to the rates set by the courier mail. The Buyer pays the delivery expenses and pays for the Products simultaneously before receiving confirmation and delivery of the Products from the Seller. The price of the delivery is included in the invoice.
  4. The Buyer can make orders 24 hours a day, but the Seller picks the orders on weekdays from 9:00 to 16:00, the orders are not picked on Saturdays and Sundays. The Seller e-mails the Buyer an order acceptance confirmation. If the Buyer does not receive a confirmation e-mail, the order has not been accepted. Picking of the order commences when the money is credited to the Seller’s account.
  5. The Buyer can exercise the right of withdrawal included in the Consumer Rights Protection Law of the Republic of Latvia and return the Products within 14 (fourteen) calendar days. In order to avoid disputes, the Buyer at the time of receipt of the Products must ascertain whether the Products correspond to the order (variety, colour, size of the plant).
  6. To exercise the right of withdrawal, the Buyer must inform the Seller of the decision to withdraw from the Contract by sending a corresponding notice in writing in free form, which includes the Buyer’s notice of withdrawal from the Contract. The notice of withdrawal is e-mailed to info@hercs.lv. Upon receipt of the Buyer’s e-mail notice, the Seller e-mails the Buyer a confirmation of receipt of the notice within one day.
  7. The Seller is entitled to not accept house plants, keeping of which during the period of the right of withdrawal did not take place in accordance with the instructions for use.
  8. The Products must be returned in their original packaging, including the instructions for use, if any were included.
  9. The Buyer is responsible for completeness of the returned Products. If the Products are not complete, the Seller does not accept the returned Products.
  10. The right providing for a withdrawal from a distance contract without stating a reason within 14 (fourteen) days is not applicable to legal entities (companies).

  12. The Seller transfers the money for the returned Products and the delivery expenses to the bank account specified by the Buyer in the withdrawal form within 14 (fourteen) calendar days after the termination of the Contract and receipt of the Products specified in the withdrawal form at the Seller’s warehouse (Pildas iela 16B, Riga) on the basis of the Buyer’s withdrawal.
  13. The average delivery time is 4 (four) to 6 (six) working days, however the Seller reserves the right to deliver the Products within 2 (two) calendar weeks, since the delivery time may vary depending on the availability of the Products in the warehouse.
  14. All prices are inclusive of 21 % VAT (Value Added Tax).
  15. The Buyer pays for the Products in the online store www.hercs.lv by credit card (MasterCard, Visa, Maestro, Visa Electron) or by transfer to SIA HERCS FLORA account number specified in the prepayment invoice. All delivery expenses are paid by the Buyer.
  16. This Contract has been drawn up in accordance with the regulatory enactments of the Republic of Latvia. The Buyer confirms that the Buyer has read the provisions of this Contract and undertakes to observe and comply with them.
  17. The Buyer is informed that the Seller is entitled to change the provisions of this Contract unilaterally at any time.
